Required Cessation Signage for Tobacco Retailers

Tobacco retailers are responsible for educating customers on the dangers of tobacco products and ensuring legal guidelines, including proper signage and age restrictions, are followed.

Effective November 1, 2018, Louisiana ACT No. 188 requires that all tobacco point-of-sale signage include: “For assistance in quitting tobacco, call 1-800-QUIT-NOW (1-800-784-8669) or visit www.quitwithusla.org.” Tobacco point-of-sale signage that does not include this language does not meet the requirements of Louisiana law. Failure to comply may result in a fine imposed by the Louisiana Office of Alcohol and Tobacco Control.

On December 20, 2019, the President signed legislation to amend the Federal Food, Drug and Cosmetic Act, raising the federal minimum age of sale of tobacco products from 18 to 21 years. It is now illegal for a retailer to sell any tobacco product, including cigarettes, cigars and e-cigarettes, to anyone under 21. Effective August 1, 2021, Louisiana ACT No. 403 changes the state minimum age of sale of tobacco products from 18 to 21 years to align with federal law. Act 403 also amends the language to refer to “point of sale” rather than “point of purchase.” Signs notifying the legal age of purchase must be displayed at the point of sale “in a manner conspicuous to both employees and consumers, within any location where tobacco products, alternative nicotine products, vapor products or vapor paraphernalia and devices are available for purchase.” The signage must still include the Quit With Us, Louisiana number – 1-800-QUIT-NOW (1-800-784-8669) – and website address, www.quitwithusla.org.

In Louisiana, approximately 1,000 children and adults die each year from secondhand smoke exposure.
